Terms of service
GENERAL TERMS
Welcome to Towelshop! In these Terms of Service, the terms “we”, “us” and “our” refer to TOWELSHOP SIA, which operates the Towelshop online store and website, including the information, content, features, tools, products and services made available through it (the “Services”). Towelshop is technically powered by Shopify.
These Terms of Service (the “Terms”), together with our Privacy Policy, Return and Refund Policy and other terms published on the website, set out your and our rights and obligations when you use the Services and make purchases.
By using the Services or placing an order, you confirm that you have read and agree to these Terms. Nothing in these Terms limits any mandatory rights granted to consumers under the laws of the Republic of Latvia or other applicable European Union legislation.
Last updated: 27 September 2026.
SECTION 1 — ACCESS AND ACCOUNT
To make a purchase independently, you must be at least 18 years old or otherwise have the legal capacity required to enter into a contract under applicable law. If a minor uses the Services, their legal representative is responsible for that use.
You may be asked to provide your email address, delivery and billing information, and other details needed to fulfil your order. The information you provide must be accurate, current and complete.
You are responsible for keeping your account credentials confidential and for activity carried out through your account. If you suspect unauthorised use of your account, please contact us immediately. You may not sell, transfer or license your account to another person.
SECTION 2 — PRODUCTS
We make reasonable efforts to display and describe our products accurately. Colours and appearance may vary slightly due to screen settings, lighting and differences between production batches. Such minor variations do not affect a consumer’s statutory rights where a product does not conform to the contract or its description.
We may change our product range, descriptions and available quantities. Changes will not affect orders already confirmed unless agreed with the customer or required to comply with applicable law.
SECTION 3 — ORDERS AND FORMATION OF THE CONTRACT
Submitting an order constitutes your offer to purchase the selected products. An automated acknowledgement that we have received your order does not necessarily constitute final acceptance. The purchase contract is concluded when we confirm the order or begin fulfilling it.
We may refuse or cancel an order if a product is unavailable, payment cannot be processed, there is an obvious pricing or product-information error, there are reasonable grounds to suspect fraud, or the order cannot lawfully be fulfilled. In such cases, we will notify you and refund any payment received.
Before submitting an order, please check the products, quantities and delivery information. Cancellation, return and exchange of an order are governed by our Return and Refund Policy and applicable law.
If you purchase goods for purposes related to your trade, business or profession, you are acting as a business customer and the specific protections granted to consumers may not apply.
SECTION 4 — PRICES AND PAYMENTS
Prices shown to consumers are final prices and include all applicable taxes unless clearly stated otherwise for a particular offer. Delivery charges and any other mandatory additional costs are shown before the order is confirmed. For deliveries outside the European Union, the recipient may be responsible for customs duties, import taxes or other destination-country charges where this is disclosed before the order is placed.
Prices, discounts and promotions may change, but changes will not affect orders already confirmed. If the terms of a promotion differ from these Terms, the specific promotion terms will apply to that promotion, insofar as they do not conflict with mandatory consumer rights.
You confirm that you are authorised to use the selected payment method and that the payment information supplied is accurate. Payments may be processed by independent payment service providers under their own terms and privacy policies.
SECTION 5 — SHIPPING, DELIVERY AND TRANSFER OF RISK
Available delivery methods, charges and estimated delivery times are shown during checkout. Delivery times are estimates unless we have expressly agreed a guaranteed delivery date.
We are not responsible for delays caused by circumstances outside our reasonable control, but this does not limit rights available to the customer under applicable law. Please contact us if delivery is substantially delayed.
Where the buyer is a consumer, the risk of accidental loss of or damage to the goods passes to the buyer when the buyer, or a third party designated by the buyer other than the carrier, takes physical possession of the goods. If the consumer independently appoints a carrier not offered by us, risk may pass when the goods are handed to that carrier, to the extent permitted by law.
SECTION 6 — INTELLECTUAL PROPERTY
The content of the Towelshop website, including trademarks, logos, text, photographs, graphics, video, design and layout, is owned by TOWELSHOP SIA, its partners or licensors and is protected by applicable intellectual property laws.
You may use the Services for personal and lawful purposes. Without our prior written permission, you may not reproduce, distribute, modify, publicly display, publish, sell or commercially exploit protected content, except where permitted by law.
The Shopify name, logo and other Shopify identifiers belong to Shopify or its respective rights holders.
SECTION 7 — OPTIONAL TOOLS AND SERVICES
The Services may include tools or features provided by third parties that we do not control. Such tools may be subject to the third party’s own terms and privacy policy. To the extent permitted by law, we are not responsible for the operation of third-party tools; however, this does not limit responsibility for obligations that cannot lawfully be transferred to another party.
Any new features and tools added to the Services in the future will also be subject to these Terms unless separate terms are provided.
SECTION 8 — THIRD-PARTY LINKS
The website may contain links to third-party websites. We do not control the content, security or privacy practices of those websites and are not responsible for transactions that you independently enter into with third parties. Please review the third party’s terms before using its services.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
Towelshop is technically powered by Shopify, which enables us to offer the Services. However, all purchase contracts in our store are entered into directly between you and TOWELSHOP SIA. Shopify is not the seller of the products and is not responsible for products sold by Towelshop, order fulfilment or purchase-related obligations, except where such responsibility arises under mandatory applicable law.
SECTION 10 — PRIVACY
The processing of personal data is governed by our Privacy Policy. Certain information may also be processed by Shopify under the Shopify Privacy Policy.
Because the Services are hosted by Shopify and we use other service providers, data may be transferred to processors in other countries in accordance with applicable data-protection laws and appropriate safeguards. Further information is available in our Privacy Policy.
SECTION 11 — FEEDBACK AND USER CONTENT
If you submit feedback, images, ideas or other content, you confirm that you have the right to provide it and that it does not infringe the rights of third parties or applicable law. You grant us a non-exclusive, royalty-free, worldwide licence to use that content for the operation, improvement and promotion of Towelshop, to the extent necessary and permitted by law.
We may remove content that is unlawful, offensive, misleading, infringes third-party rights or otherwise violates these Terms. The use and deletion of personal data are also governed by our Privacy Policy and applicable data-protection law.
SECTION 12 — ERRORS AND CORRECTIONS
We may correct obvious typographical, pricing, product-description, availability or delivery-information errors. If an error affects an order already submitted, we will notify you and offer you the choice of continuing with the corrected information or cancelling the order for a full refund.
SECTION 13 — PROHIBITED USES
You may not use the Services for unlawful or malicious purposes, to infringe the rights of others, distribute false or misleading information, harass or harm others, send spam, collect personal data without authorisation, distribute malicious code or circumvent the security of the Services.
Without our permission, you may not carry out disproportionate automated data extraction, copying or activities that disrupt the operation of the Services. We may restrict or terminate access where there are reasonable grounds to believe that you have violated these Terms or applicable law.
SECTION 14 — AUTOMATED AGENTS
In this section, an “Agent” means software or a service that accesses or interacts with the Services autonomously or semi-autonomously on behalf of a person or organisation.
An Agent must identify itself and must not impersonate a human, circumvent CAPTCHA, security or access restrictions, or conceal automated activity. We may use technical measures to restrict Agent access where necessary to protect the Services, users or our rights.
SECTION 15 — TERMINATION OF ACCESS
You may stop using the Services at any time. We may suspend or terminate an account or access to the Services if you violate these Terms or applicable law, compromise the security of the Services, or if continued provision of the Services is no longer possible.
Termination of access does not cancel obligations relating to orders already confirmed and does not limit statutory consumer rights. Provisions that by their nature are intended to survive termination will remain in effect.
SECTION 16 — AVAILABILITY OF SERVICES AND CONFORMITY OF GOODS
We do not promise that the website will always operate without interruption or error. We may temporarily restrict access for maintenance, security or technical reasons.
This limitation concerning website availability does not affect our duty to provide goods that conform to the contract. Consumers retain all rights provided by applicable law in relation to non-conforming, defective or incorrectly delivered goods. These rights cannot be restricted by a commercial guarantee or by the wording of these Terms.
SECTION 17 — LIMITATION OF LIABILITY
To the extent permitted by law, we are not responsible for indirect or unforeseeable losses that do not arise as a direct result of our breach of these Terms. If you use the Services for business purposes, we are not liable for loss of profit, business interruption or other indirect commercial loss, unless applicable law provides otherwise.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for intentional misconduct, gross negligence, death or personal injury, fraud, or infringement of mandatory consumer rights.
SECTION 18 — USER RESPONSIBILITY
You are responsible for loss caused by your unlawful, intentional or grossly negligent use of the Services to the extent provided by applicable law. This section does not impose disproportionate obligations on consumers or obligations that conflict with mandatory consumer rights.
SECTION 19 — SEVERABILITY
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect. The affected provision will apply only to the extent permitted by law.
SECTION 20 — ENTIRE AGREEMENT AND NON-WAIVER
These Terms and the policies referred to in them constitute the agreement governing use of the Services and purchases. If we do not exercise a right on a particular occasion, that does not mean that we waive that right in the future. Nothing in this section limits a consumer’s right to rely on pre-contract information or other applicable law.
SECTION 21 — ASSIGNMENT
You may not transfer your rights or obligations under these Terms to another person without our consent, except where permitted by law. We may transfer our rights or obligations to another person only in a manner that does not reduce your statutory or contractual rights. We will notify you of a material transfer where required by law.
SECTION 22 — GOVERNING LAW AND DISPUTE RESOLUTION
These Terms and purchase contracts are governed by the laws of the Republic of Latvia. If you are a consumer, this choice does not deprive you of any mandatory protection granted by the laws of the country of your habitual residence.
If a dispute arises, please contact us first so that we can attempt to resolve it amicably. Consumers may also use out-of-court dispute-resolution procedures available under Latvian law and may contact the Consumer Rights Protection Centre of Latvia or a competent court. Jurisdiction is determined by applicable law.
SECTION 23 — HEADINGS
Section headings are included for convenience only and do not affect the interpretation of these Terms.
SECTION 24 — CHANGES TO THESE TERMS
We may update these Terms by publishing a new version on the website. We will provide notice of material changes where required by law. Changes will not apply retrospectively to purchase contracts already concluded unless required by law or separately agreed with you.
Each order is governed by the version of the Terms that was in effect when the order was placed.
